The commercial company SOLVIT DOO BAR (hereinafter: “SOLVIT”, “we” or the “Controller”) pays particular attention to the protection of the privacy and personal data of its customers, users of the online store and other persons who communicate with us.
This Privacy Policy explains which personal data we collect, for which purposes we process them, on which legal grounds, to whom we may make them available, how long we keep them, as well as what rights you have regarding your personal data.
The processing of personal data is carried out in accordance with the Law on Personal Data Protection of Montenegro, as well as, where applicable, with Regulation (EU) 2016/679 (GDPR) and other applicable regulations.

2. WHICH PERSONAL DATA WE COLLECT
We collect and process only those personal data that are needed for specific, clearly defined purposes of processing.

Depending on the type of service or relationship with SOLVIT, we may process:

data required for issuing invoices and fulfilling tax and other legal obligations;
data on a legal entity or entrepreneur, including name and Tax ID, when the buyer acts as a business entity;

When visiting the online store, certain technical data may be collected automatically, depending on the site settings and your consent, when consent is required.

3. PURPOSES AND LEGAL BASES FOR PROCESSING
We process your personal data only when there is an appropriate legal basis for this.
3.1. Performance of a contract and taking steps at the request of the user
We process personal data when this is necessary for:
receipt and processing of an order;
confirmation and communication regarding the order;
preparation and delivery of products;
issuing invoices and other accompanying documents;
processing payments;
exercising warranty rights;
processing complaints, objections and service requests;
activation and registration of software or technical licences;

SOLVIT does not sell or rent the personal data of its customers and users.
We may make personal data available only when this is necessary to achieve a specific purpose of processing, for the performance of a contract, fulfilment of a legal obligation or on another appropriate legal basis.

courier and delivery services – for delivery of ordered products;
banks, payment institutions and payment service providers – for processing and execution of payments;
IT service, hosting, maintenance and software solution providers – for the functioning and maintenance of the online store, information systems and other technical solutions;

When SOLVIT entrusts the processing of personal data to another person who acts on behalf and for the account of SOLVIT, appropriate contracts or other legally binding arrangements regulating their obligations regarding the protection of personal data are concluded with such processor, when necessary.
5. TRANSFER OF PERSONAL DATA TO OTHER COUNTRIES
Depending on the information systems, software solutions, hosting or other service providers used, certain data may be processed or made available outside Montenegro.
SOLVIT will carry out such transfer or enable such access only when there is an appropriate legal basis for this and with the application of appropriate safeguards provided by applicable regulations.
Where GDPR applies to particular processing, the transfer of personal data to a third country or international organization shall be carried out in accordance with the conditions prescribed by the GDPR, including, where applicable, an adequacy decision or other appropriate safeguards.
6. RETENTION PERIOD OF PERSONAL DATA
SOLVIT retains personal data only for as long as necessary to achieve the purpose for which they were collected, that is, as long as necessary to fulfil legal obligations, protect legitimate interests or exercise and protect legal claims.
The retention period is determined according to the purpose of processing and applicable legal obligations.
Specifically:
data related to orders, invoices and business documentation are retained for the periods prescribed by tax, accounting and other relevant regulations;
data related to complaints, objections and service requests are retained for as long as necessary for their processing and resolution, as well as for the period necessary for protection against or exercise of possible legal claims;
data necessary for exercising warranty rights are retained during the period necessary for exercising warranty rights and, when necessary, thereafter for the protection of legal interests;
data processed on the basis of consent, including newsletter data, are retained until consent is withdrawn or until the need for such processing ceases;
technical and security data are retained for the period necessary for the security, maintenance and proper functioning of information systems, in accordance with applicable rules and internal procedures.
After the expiry of the relevant period, data are deleted, destroyed or anonymized, unless there is another legal basis or justified need for their further retention.
7. SECURITY OF PERSONAL DATA
SOLVIT applies appropriate technical, organizational and personnel protection measures in order to protect personal data from unauthorized access, unauthorized disclosure, loss, destruction, alteration or other unlawful processing.
Protection measures may include, depending on the type of data and information system:

Despite the application of appropriate measures, no method of transferring or storing data via the internet can guarantee absolute security.

You have the right to request correction of inaccurate or completion of incomplete personal data.
Right to erasure
You may request erasure of personal data when there is no appropriate legal basis for their further processing or when other conditions prescribed by law are met.
A request for erasure need not be accepted in cases where SOLVIT has a legal obligation to retain the data or there is another legal basis for their further processing.
Right to restriction of processing
